Our lawyers are actively following all the measures which are being put in place from time to time by the Maltese authorities in light of the COVID-19 outbreak in Malta. These measures are taking effect by means of various Legal Notices, each of which is explained hereunder.
This Legal Notice is intended to amend L.N. 96 of 2020 entitled “Enforcement of the order relating to Closure of Non-Essential Retail Outlets and Outlets Providing Non-Essential Services Regulations, 2020” which previously captured lotto booths within its scope.
This amendment was intended to bring L.N. 172 of 2020 entitled “Closure of Non-Essential Retail Outlets and Outlets Providing Non-essential Services (Amendment) Order, 2020” within the scope of the abovementioned Legal Notice, essentially removing lotto booths from within this scope of enforcement.
This Legal Notice is intended to amend L.N. 76 of 2020 entitled “Closure of Non-Essential Retail Outlets and Outlets Providing Non-essential Services Order, 2020” and L.N. 82 of 2020 entitled “Closure of Places Open to the Public (Amendment) Order, 2020”, with effect from the 4th of May 2020.
The amendment removed the wording “, lotto booths” from the said Legal Notices, effectively making the Order of Closure of Places Open to the Public inapplicable to lotto booths – which means that they can open to the general public as of the 4th of May 2020.
Notwithstanding the above, the rest of the Places Open to the Public, including the below, shall remain closed:
This Legal Notice is intended to amend L.N. 95 of 2020 entitled “Closure of Non-Essential Retail Outlets and Outlets Providing Non-essential Services Order, 2020″, with effect from the 4th of May 2020.
The amendment substituting the wording “The Superintendent of Public Health hereby orders the closure of all shops whereby their principal business relates to selling of clothing, sportswear, jewellery, hand bags and leather goods, costume jewellery and accessories, footwear, non-prescription eye-wear, perfumeries, beauty products, haberdasheries, soft furnishings, souvenir shops, discount stores, luggage shops, toy shops, hobby shops, furniture shops, florists and vaping shops, whether operating in shopping malls and/or elsewhere” with “The Superintendent of Public Health hereby orders the closure of all vaping shops, whether operating in shopping malls and/or elsewhere”, effectively making the Order of Closure of Non-Essential Retail Outlets and Outlets Providing Non-essential Services applicable only to vaping shops – which means that the rest of the mentioned retail outlets are free to open to the general public of the 4th of May 2020.
Notwithstanding this amendment, the order for closure of outlets providing non-essential services, namely hairdressers, barbers, beauticians, spas, nail artists, nail technicians and tattooists, remains in full force.
This Legal Notice is intended to increase the number of persons in any open outdoor space accessible to members of the general public established by L.N. 112 of 2019 entitled “Number of Persons in Public Spaces Order, 2020” to groups of not more than four (4) persons.
This Legal Notice is intended to amend L.N. 113 of 2019 entitled “Enforcement of the order relating to the Number of Persons in Public Spaces Regulations, 2020” which was previously applicable to groups of more than three (3) persons.
This amendment was intended to make L.N. 173 of 2020 entitled “Number of Persons in Public Spaces (Increase in Number of Persons) Order, 2020” applicable to groups of more than four (4) persons, within this scope of enforcement.
Therefore, any person who fails to abide by such prohibition shall be guilty of an offence and shall, on conviction, be liable to the payment of a penalty of one hundred Euro (€100) for each and every occasion that such order is breached.
This Legal Notice revokes L.N. 118 of 2020 entitled “Mandatory Non-essential Travel between Malta and Gozo Order, 2020”, with effect from the 4th of May 2020. Therefore, all travel between Malta and Gozo is now open to the general public.
This Legal Notice is intended to amend L.N. 61 of 2020 entitled “Epidemics and Infectious Disease (Suspension of Legal and Judicial times) Order, 2020” and L.N. 84 of 2020 entitled “Epidemics and Infectious Disease (Suspension of Legal and Judicial Times) (Amendment) Order, 2020”, with effect from the 4th of May 2020.
The amendment removed the wording “the opening of its registry” from the said Legal Notices, effectively making the Epidemics and Infectious Disease (Suspension of Legal and Judicial times) Order inapplicable to the registry of the courts – which means that any time limits imposed by law relating to the registry of courts will start running twenty (20) days from the 4th of May 2020. The twenty (20) day period was introduced by L.N. 162 of 2020 entitled “General Provisions applying to the Suspension of Legal and Judicial Times (Amendment) Regulations” which was intended to amend L.N. 141 of 2020 entitled “General Provisions applying to the Suspension of Legal and Judicial Times Regulations, 2020” which initially afforded a seven (7) day suspension pursuant to the repeal of the order of closure of the Court of Justice.
Notwithstanding the above, any other time limits which were suspended prior to the coming into force of this Legal Notice shall remain suspended.
This Legal Notice is intended to amend L.N. 65 of 2020 entitled “Closure of the Courts of Justice Order, 2020” and L.N. 97 of 2020 entitled “Closure of the Courts of Justice (Amendment) Order, 2020”, with effect from the 4th of May 2020.
The amendment removed the wording “and the registry” from the said Legal Notices, effectively making the Order of Closure of the Courts of Justice inapplicable to the registry of the courts – which means that the registry of courts can open as of the 4th of May 2020.
Notwithstanding this, any other time limits which were suspended prior to the coming into force of this Legal Notice shall remain suspended.
This Legal Notice revokes L.N. 102 of 2020 entitled “Closure of Vehicle Roadworthiness Testing Stations (Amendment) Order, 2020” and L.N. 114 of 2020 entitled “Closure of Vehicle Roadworthiness Testing Stations (Amendment No. 2) Order, 2020”, with effect from the 4th of May 2020. Therefore, all Vehicles Roadworthiness Testing (VRT) Stations can re-open to the general public.
