Transfer of Employees

Intra-corporate transfers are regulated under the Conditions of Entry and Residence of Third Country National in the Framework of an Intra-Corporate Transfer Regulations (S.L. 217.21). An intra-corporate transfer is the temporary secondment of a third-country national who resides outside Malta and who is employed by an undertaking established outside of Malta but which belongs to an undertaking or group of undertakings established in Malta. The applicant must have been employed with the undertaking or group of undertakings:

  • In the case of managers and specialists for a minimum of three up to twelve uninterrupted months immediately prior to the intra-corporate transfer;
  • In the case of trainee employees for a minimum of three up to six uninterrupted months immediately prior to the intra-corporate transfer.

Intra-corporate transferees are guaranteed the same terms and conditions of employment applicable to posted workers, except for remuneration. Third-country nationals must be given, at minimum, equally favourable remuneration as Maltese nationals in comparable positions. Applicants who satisfy such requirements are granted an intra-corporate transferee permit which constitutes an employment license. The maximum duration of an intra-corporate transfer is three years for managers and specialists and one year for trainee employees.
